What Does it Cost to File Bankruptcy?
There are two component costs of filing under either Chapter 7 or Chapter 13: (1) court filing fees and (2) attorney fees. Filing fees are fixed by law and vary depending on the type of case. At present, the filing fee for Chapter 7 is $306.00, while the filing fee for Chapter 13 is $281.00.
In most Chapter 13 cases, the attorney fee is paid through the Chapter 13 Trustee out of funds paid into the case. Therefore, the “up front” cost of a Chapter 13 is the filing fee combined with a nominal advance attorney fee (typically $0.00 to $500.00 + $281.00 filing fee = $281.00 to $774.00 total “up front” cost. Fees for small business Chapter 13 cases are a little higher.
In Chapter 7 cases, the attorney fee is $994.00, plus the filing fee of $306.00 for total fees and costs of $1,300.00, payable when your case is filed.
Some law firms charge a small fee initially, and then add additional “surprise” fees later. We do NOT do this. The fee quoted at our initial meeting is the TOTAL fee for the whole case.
